Terms
Draft, not reviewed by a lawyer. Last updated: 23 October 2026, version 1.0
This English version is provided for convenience. In case of doubt, the German version applies.
1. Scope and provider
- These terms and conditions apply to all contracts for the use of AdventJoy, a service for creating, publishing and receiving digital advent calendars.
- The provider and your contractual partner is Daniel Narum, bydaniwp (ByDaniWP Webdesign Freiburg), Stühlingerstr. 30, 79106 Freiburg im Breisgau, Germany, email hello@bydaniwp.dev ("we"). AdventJoy is a brand of bydaniwp.
- A consumer is any natural person who enters into the contract for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession when entering into the contract (Section 14 BGB).
- Deviating terms of customers do not apply, even if we do not expressly object to them.
2. Services
With AdventJoy you create an advent calendar with 24 doors in the "Polarnacht" design in your browser. Doors can contain texts, photos, voice messages, videos, vouchers or discount codes and link buttons; in the Business plan also prize draws. You share the finished calendar via a link, optionally protected by a PIN. From 1 December one more door opens every day; from 25 December all doors are open.
You can create a calendar free of charge as a draft (up to 25 MB per file and 300 MB in total). Sharing is only possible after purchase.
For private calendars (plans for consumers):

The service description shown at the time of purchase is decisive. We may develop the service further as long as the agreed features of the purchased plan are preserved. For consumers, Section 327r BGB also applies to changes to digital products.
We aim for uninterrupted availability. Short interruptions for maintenance, security updates or due to disruptions beyond our control cannot be ruled out. We only owe a specific availability if expressly agreed.
3. Conclusion of contract
- The presentation of the plans on our website is not a binding offer but an invitation to order.
- You need a customer account to make a purchase. You choose the plan and currency, accept these terms, confirm that you have read the privacy policy and, as a consumer, give your consent to immediate performance (section 10). Business customers also conclude the data processing agreement. We then redirect you to the payment page of our payment provider Stripe. There you review and correct your details and make a binding offer by clicking the button that confirms your order with an obligation to pay.
- The contract is concluded when the payment has been completed successfully and we activate your calendar. We inform you with an order confirmation by email. It contains the order summary, these terms, the withdrawal information and, where applicable, the confirmation of your consent to the early expiry of the right of withdrawal.
- The contract languages are German and English. We store the contract text. You can view and save these terms on this page at any time; your orders are shown in your account.
4. Prices and payment
- The prices shown at the time of purchase apply. All prices are final prices. No VAT is charged under the German small business scheme (Section 19 UStG).
- An introductory price applies until the time stated on the website (time zone Europe/Berlin). The time at which you start the order is decisive.
- We offer prices in euros and US dollars. The payment methods (for example credit card, PayPal, Klarna, Apple Pay, Google Pay) are shown on Stripe's payment page. Third-party payment methods are also subject to their own terms.
- The price is due immediately when the contract is concluded. You receive the invoice via a link in the order confirmation.
- Promotion codes are valid only to the extent and for the period stated and cannot be redeemed retroactively or paid out.
5. Term, availability and deletion
- A purchased calendar is available to recipients until the date stated in the plan (Standard and all business plans: 31 January 2027, Plus: 30 June 2027). The contract then ends without notice of termination.
- Until deletion you can view the content in the editor and keep your own copies of the files you uploaded. We delete calendars with all content and media on 15 February 2027 (Standard and business plans) or on 15 July 2027 (Plus). We delete drafts that were not purchased 30 days after the last change, at the latest on 15 February 2027.
- An extension or change of plan is only possible if we expressly offer it.
6. Your content and your obligations
- You are responsible for the content you add to a calendar (texts, photos, voice messages, videos, codes, links, logos). You warrant that you hold the necessary rights and that the people shown or named agree to being published in the calendar.
- In particular, content that violates laws or third-party rights (for example copyright, trademark or personality rights), depictions of sexual abuse, pornographic, violence-glorifying, hateful or discriminatory content, malware, links to such content and content that endangers children or young people is not permitted.
- Keep your editing link, sign-in details and PIN safe. Anyone who knows the editing link can change the calendar. Anyone who knows the recipient link can view the calendar unless a PIN is set.
- You must not misuse the service, in particular not query it automatically, overload it or circumvent protective measures.
- Keep your own copies of your original files. AdventJoy is not an archive; photos are resized and converted for display.
7. Rights of use
- You grant us a simple right, limited to the term and purpose of the contract, to store your content, process it technically (for example resize or convert it) and make it available to the people you share the calendar with. We do not claim any further rights. We only use calendars as an example or reference with your express consent.
- For AdventJoy itself (software, Polarnacht design, texts, fonts under their included licences) you receive a simple, non-transferable right of use for the term within the scope of these terms.
8. Reports and blocking
- Anyone can report illegal content to hello@bydaniwp.dev. We review reports promptly, diligently and objectively and inform the reporting person of our decision.
- If section 6 is violated, we may block the content concerned or the calendar. We give reasons for blocking where required by law (Article 17 of Regulation (EU) 2022/2065) and give you the opportunity to respond. If the blocking is unjustified, we lift it without delay.
- In the case of serious or repeated violations, we may terminate the contract for good cause. In that case there is no claim to a refund to the extent that you are responsible for the violation.
9. Voluntary refund for private calendars
- In addition to your statutory rights, we refund the full price of a private calendar (Standard or Plus) as a goodwill gesture if you ask us within 14 days of purchase and the recipient link has never been opened by then. An informal email to hello@bydaniwp.dev is sufficient.
- The calendar is blocked once refunded. No legal claim arises beyond this promise; your statutory rights, in particular the right of withdrawal and warranty rights, remain unaffected.
10. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. Details, including the early expiry when performance begins immediately, can be found in the withdrawal information. Businesses have no statutory right of withdrawal.
11. Warranty
- The statutory provisions apply, for consumers in particular Sections 327 et seq. BGB on digital products. During the term we provide the updates necessary to keep the service in conformity with the contract.
- Please report defects as precisely as possible to hello@bydaniwp.dev so that we can fix them quickly.
12. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
- In the case of slight negligence, we are only liable for breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.
- We are liable for loss of data under paragraph 2 only to the extent that would have occurred had you regularly kept your own copies of the original files.
- These limitations also apply in favour of our vicarious agents.
13. Special provisions for business customers
- The business plans are intended for businesses. By purchasing, you confirm that you are acting as a business. You can enter your company name and VAT ID at checkout; they appear on the invoice.
- Data processing. To the extent that we process personal data on your behalf (visitor statistics, prize draw entries, content), the data processing agreement you conclude at purchase applies. As the controller, you are responsible for the lawfulness of this processing.
- Prize draws. You are the organiser of a prize draw, not us. You are responsible for ensuring that the prize draw, official rules, privacy notice, imprint and delivery of prizes comply with applicable law, in particular in every country in which you promote the prize draw. Entry must be free of charge and must not depend on a purchase. Our official rules template is non-binding help and not legal advice; you adapt it and review it before publication. You obtain newsletter consents separately and voluntarily and send newsletters yourself.
- Mandatory information. Before purchase you provide the organiser's name and address and links to the imprint and privacy notice. We display this information in the calendar.
- Embedding. If you embed a calendar in your website via iframe, you are responsible for the privacy and cookie notices of your website. The calendar itself sets no cookies.
- Limits. The entry limit of the Business plan is 25,000 confirmed entries per calendar. Once reached, the form accepts no further entries; we inform you in good time.
- Liability. Towards businesses, our liability under section 12 (2) is limited to the amount you paid for the plan concerned; section 12 (1) remains unaffected. You indemnify us against third-party claims based on your content or your prize draw to the extent that you are responsible for the infringement.
- Place of jurisdiction. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Freiburg im Breisgau, Germany.
- The voluntary refund under section 9 does not apply to business plans.
14. Data protection
We explain how we process personal data in our privacy policy.
15. Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
- We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
- If any provision of these terms is invalid, the remainder of the contract remains valid. The statutory provisions replace the invalid provision.
- In the event of discrepancies between the German and English versions, the German version prevails to the extent permitted by law.
